Commencement of Oaths and Affirmations Act 2018

The Oaths and Affirmations Act 2018 (the Act) commenced on 1 March 2019. Honorary justices are authorised witnesses under the Act.

The Act and related regulations clarify laws about oaths, affirmations, affidavits and statutory declarations that were previously found in the Evidence (Miscellaneous Provisions) Act 1958.

The Act also provides a clear statutory process for certifying that a document is a true copy of an original document. It is important that all authorised witnesses, including all honorary justices, are aware of these changes.

The Act is designed to ensure greater access to the services of authorised witnesses in Victoria, and to ensure that flexible options can be provided for people with physical or cognitive disabilities and those with low literacy.
